Recovery generally moves through four stages: assessment of the debtor's solvency and the merits of the claim, an amicable demand and negotiation period, litigation in the UAE civil or commercial courts (or the DIFC Courts, where the contract permits) if the debtor does not settle, and enforcement of any judgment against the debtor's assets in the UAE. As a US creditor you can pursue a UAE debtor directly; the UAE is not party to the US's civil judgment recognition treaties, so a US judgment generally cannot simply be transplanted and enforced in the UAE — claims are usually pursued fresh through the UAE court system, which is the route we manage on your behalf from start to finish.

Because there is no direct treaty between the US and the UAE for automatic recognition of civil judgments, a default judgment obtained in a US court will usually need to be re-litigated, in substance, before a UAE court rather than simply registered and enforced. This surprises many US creditors, who assume a judgment is a judgment everywhere. Building the claim correctly under UAE procedure from the outset — rather than trying to import a US judgment after the fact — is generally the faster and less expensive path.

US supply contracts are typically UCC-based, with detailed warranty, inspection and remedy provisions. Those terms often decide whether a withheld payment is a genuine set-off or straightforward non-payment.

Export documentation — bills of lading, inspection certificates and delivery confirmations — is normally the strongest evidence in the file. Assembling it before the first demand shortens the amicable stage considerably.
