The UAE courts may take into consideration the parents’ religion, place of permanent residence, income, and the mother’s subsequent marital status when determining the case of custody. Under articles 78, 146, and 156 of the UAE Personal Status Law, a Muslim mother would have custody of children on divorce until the boy is 11 and the girl 13. After this duration, custody could revert to the father in case he applies for it. On the other hand, the Muslim father is prioritized, irrespective of his nationality when the mother is non-Muslim.
